Bail
Bail is a legal mechanism that allows an accused person to be released from custody, typically on the condition that they will appear in court when required. It serves to balance the presumption of innocence until proven guilty with the need to ensure the accused’s appearance at trial and prevent them from committing further offenses or interfering with the judicial process.
Legal Framework
In India, the provisions regarding bail are primarily governed by the Criminal Procedure Code (CrPC), 1973. The CrPC distinguishes between bailable and non-bailable offenses, which determines the conditions and procedures for granting bail.
Types of Bail
- Regular Bail: Granted to an accused after their arrest and during the pendency of the trial.
- Interim Bail: Temporary bail granted before a hearing for the grant of regular or anticipatory bail.
- Anticipatory Bail: A pre-arrest bail granted under Section 438 of the CrPC to a person who anticipates arrest on accusation of a non-bailable offense.
Bailable and Non-Bailable Offenses
- Bailable Offenses: In cases of bailable offenses, the accused has the right to be released on bail. The police or the court can grant bail as a matter of right.
- Non-Bailable Offenses: For non-bailable offenses, bail is not a matter of right and is granted at the discretion of the court. The court considers several factors, including the seriousness of the offense, the accused’s criminal history, and the likelihood of the accused fleeing or tampering with evidence.
Conditions for Granting Bail
Courts may impose certain conditions when granting bail, such as:
- Surrendering the passport to prevent the accused from leaving the country.
- Regularly reporting to the police station.
- Providing sureties or a bail bond as a guarantee of compliance.
- Refraining from contacting witnesses or tampering with evidence.
Revocation of Bail
Bail can be canceled if:
- The accused violates the bail conditions.
- The accused commits another offense while on bail.
- There is a misuse of liberty granted by the court.
- New evidence emerges that justifies the cancellation of bail.
