FIR Quash

The legal provision for quashing an FIR is found under Section 482 of the Criminal Procedure Code (CrPC), 1973, which grants the High Courts inherent powers to prevent the abuse of the process of any court or to secure the ends of justice.
Grounds for FIR Quashing
An FIR can be quashed by the High Court on various grounds, including but not limited to:

- Lack of Prima Facie Case: If the FIR does not disclose any cognizable offense or the allegations do not constitute an offense.
- Malicious Intent: If the FIR is lodged with malicious intent or is politically motivated.
- Settlement Between Parties: In cases involving non-compoundable offenses, if both parties have reached a settlement, the court may quash the FIR in the interest of justice.
- Jurisdictional Errors: If the FIR is filed outside the jurisdiction of the concerned police station.
- Absence of Factual Foundation: If the allegations are absurd or inherently improbable, making it impossible for any prudent person to reach a just conclusion that there is sufficient ground for proceeding against the accused.
